All You Need to Know about Title Deed in Turkey

Types of Title Deed Documents in Turkey

1. Agricultural Land Document

It is the title deed of agricultural lands or lands of a field character, which gives its owner the authority to establish all agricultural projects, such as: agriculture, poultry and livestock breeding.

In the event that these lands are used in an illegal manner, such as for building on them, their owner is subject to legal accountability.

It is noteworthy that the agricultural land in the title deed if it acquired the status of reconstruction later as a result of a change in the reconstruction plan for the area to which it belongs; You must go to the municipality to change of the property.

2. Building Document in Turkey

The building title deed includes only general information about the documented property, and is specific to independent houses, warehouses, palaces and villas, stores, warehouses, as well as restaurants and schools.

3. Real Estate Easement Deed in Turkey

A property document that records the divisions of the property separately, just as each apartment within the residential buildings is registered independently, enabling each investor to obtain his real estate share of the building.

5. Commercial Real Estate Title Deed

It is the title deed of commercial real estate, such as: offices, shops, stores, and other real estate units that are used for commercial purposes.

6. Transitional Title Deed "Time Share Scheme"

An official document that guarantees a person the right of ownership in the property for a specific period of the year, provided that the period of use of the property is specified in the document.

This type of document is common in real estate for holidays and the like, and according to it the owner obtains full ownership rights; From selling, leasing and transferring ownership to others, but according to the period specified for it in the transitional title deed.

7. Full Title Deeds

The owner extracts this document after the full completion of the construction of the property; It includes information about: the type of property, its number, its location in the building, in addition to the property's share of the building land. In this case, the property obtains the right of real estate easement or full ownership.

Procedures for Obtaining Tapu in Turkey

  • Conclusion of the purchase contract between the seller and the buyer.
  • Pay the agreed amount for the value of the property.
  • Apply for transfer of ownership.
  • The signature of the two parties on the purchase document in the title deed department.
  • The buyer receives the new title deed in his name, which proves his ownership of the property.
  • If the buyer is a foreigner, a certified sworn translator must be present with him, so that the title deed officer is sure that the buyer understands all the terms of the title deed.

Required Documents to Get Title Deed from Land Registry Office

  • The identity document of the seller and the buyer.
  • Recent photos of the seller and two photos of the buyer.
  • Earthquake Insurance Certificate - DASC.
  • A document from the municipality on the condition of the property.

In the absence of either the seller or the buyer, a certificate of authorization can be submitted to the real estate agent, in addition to an official power of attorney certified by the Turkish Consulate and the Notary Public to complete the procedures in the presence of the agent.
